1. Acceptance
These Terms of Service govern your use of the Top Shelf Media Co website, client portal, and services. By using this website or engaging our services, you agree to these terms. If you do not agree, do not use the site or our services.
Top Shelf Media Co is a trade name of Top Shelf Media Company LLC, a South Carolina limited liability company located at 113 Court Street, Unit C, Pickens, SC 29671.
2. Services
Top Shelf Media Co provides marketing and creative services including brand strategy, photo and video production, website design, search optimization, social media management, and paid advertising. The specific scope, deliverables, timeline, and fees for any engagement are set out in a separate written agreement between Top Shelf Media Co and the client. Where these Terms conflict with a signed client agreement, the signed agreement controls.
3. Client Responsibilities
Clients agree to provide accurate information, supply materials and approvals within agreed timeframes, and hold the necessary rights to any content, trademarks, or materials they provide to us for use.
4. Fees and Payment
Fees, payment schedules, and terms are established in the applicable client agreement or proposal. Amounts are due as stated in that agreement.
5. Intellectual Property
Ownership and licensing of work product are governed by the applicable client agreement. Unless that agreement states otherwise, Top Shelf Media Co retains ownership of preliminary concepts, working files, and materials not delivered as final deliverables, and retains the right to display completed work in its portfolio and marketing materials.
Website content, branding, and materials on this site are the property of Top Shelf Media Company LLC and may not be reproduced without permission.
6. Confidentiality
Each party agrees to protect the other’s confidential business information and not to disclose it to third parties except as necessary to perform the services or as required by law.
7. Third-Party Services
Our services may involve third-party platforms and tools. We are not responsible for the availability, performance, policies, or actions of third-party providers.
8. SMS Programs
Top Shelf Media Co operates two separate SMS programs. Consent to one is not consent to the other, and each is opted into separately.
Client notifications (transactional). Sent only to designated staff contacts at businesses under active service contract with us, who have opted in through the Top Shelf Media Co client portal. Messages relate to work in progress: content ready for review, reminders about outstanding approvals, task reminders, and upcoming shoot or meeting notifications. Recipients may reply, and we respond to questions about project status. Routine replies may be answered by an automated assistant, which escalates anything else to a member of our staff. This program sends no marketing or promotional content.
Marketing and promotional. Sent only to people who have separately and explicitly opted in on one of our forms by checking a marketing consent box. Messages include offers, announcements, and promotional content about our services. This consent is never required to submit a form, download a resource, or purchase anything.
Consent. By providing your mobile number and checking the applicable consent box, you agree to receive SMS messages from Top Shelf Media Co at that number, including messages sent by automated means. Consent is not a condition of any purchase or service.
Message frequency. Message frequency may vary.
Cost. Message & data rates may apply. Contact your wireless provider for details on your plan.
Opt out. Reply STOP to any message to unsubscribe from that program. You will receive a single confirmation, after which no further messages will be sent. Reply HELP for assistance, or contact us at dusty@topshelfmediaco.com or (864) 788-2170.
Supported carriers. Message delivery is supported on major U.S. carriers. Carrier support may change without notice.
Privacy. See our Privacy Policy at topshelfmediaco.com/privacy-policy. Mobile information and SMS consent will not be shared with or sold to third parties or affiliates for marketing purposes.
9. Carrier Liability
Carriers are not liable for delayed or undelivered messages. Top Shelf Media Co is not responsible for any delays, failures, or errors in message delivery caused by mobile carriers or network conditions.
10. Age Restriction
You must be at least 18 years of age to opt in to receive SMS messages from Top Shelf Media Co. By providing your phone number and consenting to receive messages, you represent that you are 18 years of age or older.
11. Disclaimers
This website and its content are provided as is. Top Shelf Media Co makes no warranties regarding the accuracy or completeness of website content. Marketing results depend on factors outside our control, and no specific outcome is guaranteed except where expressly stated in a signed client agreement.
12. Limitation of Liability
To the fullest extent permitted by law, Top Shelf Media Company LLC is not liable for indirect, incidental, consequential, or punitive damages arising from use of this website or our services. Liability under any client engagement is governed by the applicable client agreement.
13. Indemnification
Clients agree to indemnify Top Shelf Media Company LLC against claims arising from materials the client provided to us, or from the client’s use of deliverables in a manner outside the scope of the applicable agreement.
14. Termination
Termination of any engagement is governed by the applicable client agreement. We may restrict access to this website or the client portal at our discretion.
15. Governing Law
These Terms are governed by the laws of the State of South Carolina, without regard to conflict of law provisions.
16. Changes to These Terms
We may update these Terms from time to time. The date at the top of this page reflects the most recent revision. Continued use of the site after changes are posted constitutes acceptance.
